These General Conditions govern the online sale of coffee (beans, ground coffee, capsules), coffee machines, and accessories through the Rude Coffee website to consumers (B2C) and professional customers (B2B). Product images are for illustrative purposes only; actual packaging may vary.
3. Conclusion of the ContractThe contract is deemed concluded when the customer receives the order confirmation email. The Seller reserves the right to cancel orders in the event of obvious pricing errors, stock unavailability, or incomplete/incorrect customer data.
4. Prices and Payment MethodsAll prices are expressed in Euros and include VAT. Payments are processed through secure external payment gateways. The Seller does not have access to or store users’ credit/debit card details.
5. Shipping and Transfer of Risk- Consumers (B2C): Pursuant to Article 63 of the Italian Consumer Code, the risk of loss or damage to the goods passes to the customer only when the customer (or a third party designated by them) physically takes possession of the products.
- Professionals (B2B): The risk passes to the customer at the time the goods are handed over to the carrier.
- Delivery times indicated on the website are purely indicative and not binding.
The consumer has the right to withdraw from the contract within 14 days from delivery.
- Exclusions (Art. 59 Italian Consumer Code): The right of withdrawal does not apply to the supply of sealed food products that are not suitable for return for hygienic reasons or health protection purposes and that have been opened after delivery. Opened, tampered with, or partially consumed coffee cannot be returned.
- Return Shipping Costs: Return shipping costs are borne exclusively by the customer.
- Return Address: Goods must be sent to the Operational Office at Via Darwin 2, interno C3, 20019 Settimo Milanese (MI), Italy.
- Refund: The Seller will refund the amount paid (including standard delivery costs) within 14 days of receiving the returned goods, subject to verification of the integrity of the seals.
- Consumer Customers: A 24-month legal warranty applies for conformity defects relating to machines and accessories. For coffee products, the warranty covers only evident defects present at the time of delivery (e.g. damaged or perforated packaging).
- Professional Customers: The warranty provided by the Italian Civil Code applies (12 months).
